Rental Terms and Conditions

1. Introduction
  1. These terms and conditions govern the rental of vehicles ("Vehicle") from GTec Associates Pty Ltd ("Company") and constitute a legally binding agreement between the Company and the renter ("Renter"). By renting a Vehicle from the Company, the Renter agrees to abide by these terms and conditions.
2. Vehicle Usage
  1. The Vehicle shall be used solely for personal transportation purposes within the metropolitan areas of Gold Coast and Brisbane, unless otherwise approved by management.
  2. The Renter shall not use the Vehicle for any illegal purposes, including but not limited to transporting illegal substances or engaging in illegal activities.
  3. Smoking is strictly prohibited inside the Vehicle. A cleaning fee will be charged to the Renter if evidence of smoking is found upon return of the Vehicle.
  4. The Vehicle must be returned to the Company in a clean and tidy condition. A cleaning fee may be charged if the Vehicle is returned dirty.
  5. Return Condition: The vehicle must be returned in the same condition as when it was rented, free from any damage.
    1. Damage is defined as any harm or impairment that affects the functionality, safety, or appearance of the vehicle, excluding general wear and tear. Definition of Damage, includes, but is not limited to:

a) any loss or damage to the vehicle, however caused, that requires repair or replacement, subject to reasonable wear and tear; cracks or chips on the windshield: Any breakage, crack, or chip in the windshield glass, regardless of size. body and paint damage: any dents, scratches, or deformities on the vehicle's exterior panels, doors, bumpers, or roof. tyre damage: any punctures, cuts, or bulges on the tyres, or damage to the rims and hubcaps. interior damage: any stains, tears, burns, or damage to the upholstery, dashboard, or other interior surfaces. mechanical damage: any impairment to the vehicle’s engine, transmission, brakes, or any other mechanical component not due to normal use. b) towing and salvage fees; c) assessing fees; and d) loss of use, and for the removal of doubt, damage to the vehicle’s windscreen, lights, wheels or tyres that makes the vehicle unroadworthy is not fair wear and tear.

1. Rights of Vehicle
  1. The vehicle has only been leased to undersigned and no unauthorised payments/transfers/loaning of vehicle is permitted without prior written consent from the registered owner.
2. Vehicle Repossession
  1. The Company reserves the right to repossess the Vehicle at any time if the Renter violates the terms and conditions of the rental agreement or if the Vehicle is used in a manner that endangers the safety of others.
  2. In the event of repossession, the Renter shall be responsible for any costs associated with recovering the Vehicle, including but not limited to towing fees.
3. Weekly Kilometre Cap (If Applicable)
  1. Some rental vehicles have a weekly kilometre limit as specified in the rental agreement.
  2. The standard weekly kilometre limit is set at 700 kilometres per week. Additional kilometre packages may be purchased at the time of booking or during the rental period.
  3. Exceeding the weekly kilometre limit without purchasing additional kilometre packages will result in an excess kilometre fee charged to the Renter.
  4. Kilometres driven will be calculated from the odometer reading at the time of pick-up to the odometer reading photographed and reported to the company each week when paying the rent.
4. Minimum Rental Term and Notice Period
  1. The minimum rental term is 4 weeks. Failure to meet this will result in forfeiting of the bond.
  2. If the Renter returns the vehicle within the 4-week minimum rental term, the rental amount for the outstanding weeks (up to the four weeks) is payable.
  3. If the Renter returns the vehicle without providing two weeks' notice, two week's rent will be deducted from the bond in addition to any other applicable charges.
5. Payment Terms
  1. Rental period is from Monday-Sunday.
  2. Rent is due on every Monday for the upcoming week of rental. Failure to make payment may result in the termination of the rental agreement and repossession of the Vehicle.
  3. Payment may be made via bank transfer or credit card, debit card (service fees apply) Proof of payment is to be send to Management, clearly showing the Bank account and reference information.
  4. There are no discounts or reductions unless approved by management.
6. Bond/Security Deposit
  1. Bond refund process can take a minimum of ten (10) Business days. This allows for any toll notices or fines to be delivered to the company before finalising accounts.
  2. The bond will only be refunded if:
    1. the vehicle is returned in the same condition as when the lease has been signed,
    2. the renter has no outstanding debts,
    3. all notice periods and the minimum rental period have been served. (as outlined in point 6)
7. Outstanding Debt
  1. Renter gives permission for items to be repossessed by the company should they have an unpaid debt outstanding for more than 2 weeks or other ongoing unpaid debt
8. Updating Information
  1. Renter agrees to inform management in the event of any changes in personal details especially mobile number, email address or residential address
9. Travel Outside Designated Regions
  1. Any travel outside the metropolitan areas of Gold Coast or Brisbane must be submitted for management approval prior to departure.
  2. Approval for travel outside designated regions is subject to management discretion and may be granted or denied based on factors such as distance, road conditions, and rental duration. Travel outside designated regions may be subject to excess fees.
  3. If approved, the Renter may be required to pay additional fees or obtain additional insurance coverage for travel outside designated regions.
10. Vehicle Inspection
  1. The Renter is required to inspect the Vehicle for any existing damage or defects before taking possession.
  2. Any pre-existing damage or defects should be documented and reported to the Company before departure to avoid liability for damage not caused by the Renter during the rental period.
  3. The company reserves the right to compare images of the condition of the returning vehicle to images within the agreement form
11. Insurance Coverage
  1. The rental fee includes basic insurance coverage for the Vehicle, subject to the terms and conditions of the insurance policy.
  2. Additional insurance coverage options may be available for purchase at the time of booking or during the rental period.
  3. Any Damage inflicted on the vehicle while being in possession of the Renter will be dealt with and payable by the respective Renter (Including the cost to recover the vehicle to the Company)
  4. The Renter acknowledges and agrees that they shall be liable for payment of the applicable insurance excess in the event of any loss or damage to the vehicle or to third party property, regardless of fault. The Company reserves the sole discretion to determine whether the Renter is responsible for any such excess, including in circumstances where fault is disputed or not established. This obligation applies irrespective of whether the Renter believes they were not at fault.
  5. Any incidences are to be reported within 24 hours to the company, renter is to follow the provided advice.
  6. All Accidents must be reported to the company within 24 Hours, extra excess amounts maybe applicable if failure to do so.
  7. If there is evidence of reckless or dangerous driving by the Renter, the Renter shall be solely liable for all costs arising from any resulting damage. This includes, but is not limited to, the full cost of vehicle repairs, recovery expenses, and any additional costs incurred by the Company in relation to the incident.
12. Maintenance and Breakdown
  1. The Company is responsible for maintaining the Vehicle in roadworthy condition and will provide roadside assistance in the event of a breakdown.
    1. All breakdowns are to be reported immediately to +61432536101 via phone, in case no one answers wait with the vehicle for at least 2-3 hours in a safe place/secure parking area with the car locked.
  2. The Renter must promptly report any mechanical issues or breakdowns to the Company and follow instructions for seeking assistance, and allow for them to be investigated and repaired in a promptly manner.
13. Fuel
  1. Vehicle is to have a full tank of fuel when returned to the Company. In the event that the vehicle is not full, follow the instructions of the company to rectify the situation.
  2. In the event that the vehicle is returned with less than full tank, the renter is liable to cover the cost of the fuel and excess fees apply.
14. Etag
  1. It is mandatory for the renter to use their own e-tag, the Company will not be responsible for any fines related to toll notices. An administration fee of $10 per toll will apply for each notice transfer into the responsible person's account.
  2. The Company accepts no responsibility for e-tags that are left in the vehicle after return, or personal e-tags or toll accounts that remain registered to the vehicle. It is the renter's role responsibility to ensure their e-tag is removed and their toll account is updated upon return of the vehicle.
15. Termination of Agreement
  1. The Company reserves the right to terminate the rental agreement at any time if the Renter breaches these terms and conditions or engages in unlawful or prohibited activities.
  2. In the event of termination, the Renter must return the Vehicle immediately and may be subject to additional fees or penalties.
16. Governing Law
  1. These terms and conditions shall be governed by and construed in accordance with the laws of the state of Queensland. Any disputes arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the state of Queensland and the Australian federal court.
17. Miscellaneous
  1. These terms and conditions constitute the entire agreement between the Company and the Renter and supersede any prior agreements or understandings, whether written or oral.
  2. The Company reserves the right to amend these terms and conditions at any time without prior notice. Any amendments will be effective immediately upon posting on the Company's website.
  3. The headings used in these terms and conditions are for convenience only and shall not affect the interpretation of the provisions herein.
18. Acknowledgment
  1. By renting a Vehicle from the Company, the Renter acknowledges that they have read, understood, and agreed to abide by these terms and conditions.
  2. These terms and conditions are effective immediately upon signing of the rental agreement until the vehicle has been returned to the company and all accounts, and outstanding debts etc are settled.
